By creating an account or accessing any part of our service, you agree to be bound by these terms.
1 Acceptance of Terms
These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and ScanMyNest ("Company," "we," "us," or "our") governing your access to and use of the ScanMyNest platform, website, and all related services (collectively, the "Service"), accessible at scanmynest.com.
By registering for an account, accessing, or using the Service in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Service.
2 Eligibility
You must meet the following requirements to use ScanMyNest:
- You must be at least 18 years of age.
- You must have the legal authority to enter into a binding contract.
- If registering on behalf of a business, you must have the authority to bind that business to these Terms.
- You must not have been previously suspended or banned from the platform.
- You must provide accurate, complete, and current information during registration.
3 User Accounts and Roles
ScanMyNest operates with the following user roles, each with distinct permissions and responsibilities:
- Homeowner: May create home profiles, track projects, manage equipment/documents, and search for contractors.
- General Contractor (GC): May create and manage projects, invite and assign subcontractors, and manage project media and documentation.
- Subcontractor (Sub): May view assigned projects, upload trade-specific media, and manage their public contractor profile.
- Administrator: Internal role with platform-wide access and management capabilities.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately at support@scanmynest.com if you suspect any unauthorized access.
We reserve the right to suspend or terminate accounts that violate these Terms or that we determine, at our sole discretion, to be harmful to the platform or other users.
5 Contractor Listings and Directory
Contractors who create a public profile and are listed in the ScanMyNest directory agree to the following:
- All information provided in your contractor profile, including license numbers, insurance status, service areas, and trade designations, must be accurate, current, and truthful.
- You are solely responsible for maintaining valid licenses and insurance for the trades you list.
- ScanMyNest does not verify, endorse, or guarantee the qualifications, credentials, or work quality of any contractor listed on the platform.
- Listing in the ScanMyNest directory does not constitute a referral, recommendation, or endorsement by ScanMyNest.
- We reserve the right to suspend or remove any contractor profile that contains inaccurate information, violates these Terms, or receives sustained negative feedback.
- Contractors who provide false license or insurance information may be permanently banned from the platform and reported to relevant licensing authorities.
Homeowners using the contractor directory acknowledge that they engage contractors independently and at their own risk. ScanMyNest is not a party to any agreement between a homeowner and a contractor.
6 User-Generated Content and Media Uploads
You may upload photos, videos, documents, and other content ("User Content") to the platform. By uploading User Content, you:
- Represent that you own or have the right to share such content.
- Grant ScanMyNest a limited, non-exclusive, royalty-free license to store, display, and process your content solely for the purpose of providing the Service.
- Agree not to upload content that is unlawful, defamatory, obscene, infringing, or harmful.
- Agree not to upload content that contains personally identifiable information of third parties without their consent.
We reserve the right to remove any User Content that violates these Terms without notice. Uploaded files are subject to size limits, MIME type restrictions, and storage policies, which may change from time to time. We do not guarantee indefinite storage of User Content and recommend you maintain your own backups.
7 QR Code Access
ScanMyNest uses QR codes and secure access tokens to provide quick access to home and project information. By using QR code features, you acknowledge and agree that:
- QR codes and access tokens are tied to specific homes or projects and are scoped to the permissions granted by the account owner.
- You must not share QR codes or access tokens with unauthorized parties.
- Access tokens may expire or be revoked at any time by the account owner or by ScanMyNest for security purposes.
- ScanMyNest is not responsible for unauthorized access resulting from a User's failure to keep QR codes or tokens secure.
8 Acceptable Use Policy
You agree NOT to use the Service to:
- Violate any applicable local, state, national, or international law or regulation.
- Upload or transmit malware, viruses, or any malicious code.
- Attempt to gain unauthorized access to other accounts, systems, or networks.
- Scrape, crawl, or data mine the platform without prior written consent.
- Harass, threaten, or harm other users on the platform.
- Submit false, misleading, or fraudulent information — including fake contractor credentials or license numbers.
- Engage in any activity that disrupts or interferes with the integrity or performance of the Service.
- Impersonate another user, contractor, or ScanMyNest representative.
9 Fees and Payments
Certain features of ScanMyNest may be offered on a paid basis, including but not limited to featured contractor placement, promoted listings, and premium subscription tiers. Where fees apply:
- All fees are displayed clearly before purchase.
- Payments are processed securely through third-party payment processors. ScanMyNest does not store full payment card data.
- Subscription fees are billed on a recurring basis unless cancelled prior to the next billing cycle.
- All sales are final unless otherwise stated in a specific refund policy. Contact support@scanmynest.com for billing disputes.
- We reserve the right to change pricing with reasonable notice to existing subscribers.
10 Intellectual Property
All content, design, code, trademarks, logos, and materials that are part of the ScanMyNest platform — including the word mark "ScanMyNest" — are the exclusive intellectual property of ScanMyNest or its licensors and are protected by applicable intellectual property laws.
You may not copy, reproduce, distribute, modify, create derivative works from, or publicly display any portion of the platform without our prior written consent. Your use of the Service does not grant you any ownership rights to our intellectual property.
You retain ownership of User Content you upload, subject to the limited license described in Section 6.
11 Disclaimers
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED/ERROR-FREE SERVICE.
ScanMyNest does not warrant that:
- The Service will always be available, accurate, or free from errors.
- Any contractor listed on the platform is licensed, insured, or otherwise qualified.
- Results obtained from using the Service will meet your expectations.
- Data or files stored on the platform will be preserved indefinitely.
ScanMyNest is a technology platform only and is not a licensed contractor, home inspector, or real estate professional. Nothing on the platform constitutes professional advice.
12 Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SCANMYNEST AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO:
- Loss of data, profits, business, or goodwill
- Damage resulting from contractor work found through the platform
- Unauthorized access to your account or data
- Any service interruption or downtime
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO SCANMYNEST IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00).
13 Indemnification
You agree to defend, indemnify, and hold harmless ScanMyNest and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to:
- Your use of the Service
- Your violation of these Terms
- User Content you upload or share
- Your interactions with other users or with contractors found through the platform
- Any false or misleading information you provide
14 Termination
We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, if we determine that you have violated these Terms or engaged in conduct harmful to the platform, other users, or ScanMyNest.
You may terminate your account at any time by contacting support@scanmynest.com. Upon termination, your right to access the Service will cease immediately. We may retain certain data as required by law or for legitimate business purposes.
Sections 10 (Intellectual Property), 11 (Disclaimers), 12 (Limitation of Liability), 13 (Indemnification), and 16 (Governing Law) shall survive any termination of these Terms.
15 Changes to Terms
We may update these Terms from time to time. When we do, we will revise the "Last Updated" date at the top of this page and, where material changes are made, we will notify active users via email or a notice within the platform. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms.
We encourage you to review these Terms periodically to stay informed of any updates.
16 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Florida.
